Orthodox, backward, narrow minded – that is how we define the Indian society and it is the people of this society who are shy, conventional and afraid of discussing sensitive topics like prostitution. But in the modern world of today, with everything progressing at a fast pace, it is high time that the Indian society comes out and talks about the controversial topic and does something concrete regarding it.

While the oldest profession in the world has been accorded legal sanction in various countries across the globe, the laws in India pay scant respect to the views of economically-advanced societies. What then, stops us from legalising prostitution when such a step can help curb exploitation of sex-workers by those who run the trade and, more importantly, assure better health for the prostitute, her client, his wife and yet unborn children.

More dirt piles up by sweeping issues under the carpet. Prostitution is a flourishing economic enterprise in India and should be recognised as such.

Closeting the oldest profession known to mankind as a morality issue not only amounts to ignoring the exploitation of the commercial sex-worker by parasites, who feed on the income she generates, but the larger issue of AIDS — a scourge which is on the verge of wreaking a global apocalypse.

What is required is a practical rather than a puritan approach. By according legitimacy to the sex-worker, millions of women who ply this trade to feed their families will be freed from the clutches of pimps, brothel-owners and cops on the take.

Additionally, in traditional red-light areas, the workable practice of targeted intervention will gain effectiveness.

Legalising prostitution will see these women, who live life on the edge everywhere, gaining access to medical facilities which can control the spread of AIDS, not only among sex-workers themselves but, at a more macro level, the customer, his wife and potential progeny.

Numerous nations across the globe which have legalised prostitution see strength in this argument. By failing to pay heed to the world order, India has only made prostitution a criminalised whirlpool involving various mafiosi — both governmental and otherwise — and a health hazard for women who are the victims rather than the vectors of AIDS.

Voices which speak in favour of legalising prostitution realise that a progressive society doesn’t ignore certain parts of its whole, but lives and lets live. Indeed, there is a very strong case to treat the sex industry as any other industry and empower it with legal safeguards which would rid this workplace of exploitative and unhealthy practices.

  1. well written article. gud work. u r right. in india people dont pay heed to this very issue. it is a taboo for some and means of living for others. but india is replete wid conservative double faced people or hypocrites. one needs to certainly broach dis topic and put into d youth's and for that matter one and all's notice. im wid u on dis

  7. Great article. And I totally agree with you. But all Indians do not have the same mentality. Otherwise me and you would not have had the courage to discuss this otherwise sensitive issue. Although "conventional wisdom" tells us that this is a low profession, Indians need to realise that it exists only because there is a demand for it.

  8. i agree 2....later ill tell u abt the indian laws abt prostitution....n how they are ambiguous regarding the entire issue....but temme u guyzzzz....u totally suppor legaliztion rite????? like converting it into a proper industry.....regular medical check ups for free, ID cars for prostitutes, licenses for brothel owners....or do u support criminalizing it completely?????

  9. na na not criminalising it yaar. dat certainly isnt a viable or rather feasible option.you see its the nature of their work which evokes filth and a sense of evasion in us. but is unfounded. this certainly stands as an issue between the present and previous generation. d present "awakened generation" in my view certainly will usher in a sea change.

  10. Well Sonali you are absolutely right in advocating the idea that prostitution should be legalized. I appreciate your bold ideology. You are very passionate about the cause you are fighting for. And moreover you have ably supported it with proper arguments. But I think that you need to be more circumspect when dealing with such an issue considering the fact that such legalisation could have disastrous consequences for Indian way of life and the familial values. Well I am not being anti-progress but the reality is that such ideas do not exist in real world. You are very well aware of the consequences of such a step. Not everything can be left to demand and supply principle. You need to draw a line at some point of time.Consider this fact- You said that the demand for prostitution is very high in India so by legalising it you give license to people to resorting to such lowly way of livelihood. No matter what you preach you should know that you might think that your cause is right but ask sex workers what do they feel about their profession...I will give you an instance- Germany has legalised prostitution and the number of clients per worker is limited. But in the FIFA world cup of 2006, spectators came from all over the world and the so called legal machinery to protect the interests of sex workers failed badly. You are fighting for a lost cause. This is a brutal world where the so called civilized people if given a chance will torture and eat each other up. The only solution to prostitution is its complete eradication.

  11. well. i agree wid siddharta in his 1st 2 phrases but not the second one. i gotta tel u dude. dere is sumtin known as learnin from precedents. what happened in germany was bitter yet true but it can be taken as a lesson for us. u c india might value ethical values but dis cant b devalued either. u talk of familial values. all i can say is lol. well mate how blatantly and openly are d so called familial values being flouted. i also will elaborate wid an instance. do u know dat boyfriend girlfriend ulture is anti familial values and indian culture? so y are we feigning it? if u answer dis u wil get d reply as to why supporting prostitution isnt a lost cause. well if u r unable to fathom anything irrelevant i gotaa tel u. its dat dude we have to move on. our previous generations desreve credit for valuing the morals but dey were wrong in being overtly conservative and prostitution isnt a taboo at all.u c people lik u r indirectly advocating rape and sexual abuse. how will u otherwise quench ur sexual desire? no brothels no harlots. jus d neighbour to molest to satiate ur sexual hunger. dude everything is made and supported for a cause. dis aint no waste of time.

  12. u are so rite parmesh....siddhart v cant just jump to eradication....u cant just wake up one day into a world in which words like 'prostitute', 'fallen women', 'tawaif', 'randi'...dude think practical....n if u think eradication is possible....do let me know how....at least legalizing will improve the current position...it will reduce the crime against the sex workers to some extent....n provide them with better facilities and security....the current laws are ambiguous.....they allow it but hide it....at least if the entire process comes into the light....a better eye can be kept to make sure there's no exploitation.....brothel owners don't hog on their salaries.....

  14. well, i have to say, ur absolutely right sonali...... legalizing this profession would make life a hell of a lot easier and safer for prostitutes and the people in their lives..... I think spreading awareness about prostitution and removing the hesitation that people in our country have in talking about issues like AIDS, prostitution, etc. is extremely imp. Excellent work!!!!

Afterall it is da Indians who use such prostitutes, then why must they be afraid to talk bout it!! being shy will lead us no where... there must be some concrete steps taken to help leaglise prostitution... great piece of work!!!

  16. the concrete steps Parul is tokin about...need to be taken by us....Gen X....coz like i always say...we are the future....policy makers, lawyers, judges, politicians..... if v dont take the steps....who will....so.....i reallly reallly want you guyzzz.....2 give in ur suggestion.... steps v can take to legalize prstitution.... licensing of brothels..... free regular health check ups for women....wat els????? put in ur views.....   19. first nd foremost step shud b dat ppl open up bout da very existence of prostitutes... ppl shy away frm acceptin this a main stream business nd dat's da basic reason y it has never been legalised, nor any steps ve been taken to legalise it... i wud suggest dat spreadin awareness must b da first step...

Legalizing prostitution is undoubtedly a stepping stone in the right direction.Not only will it bring back these women from the fringes of society ,it will also mark a revolution in the control of AIDS and other STD's.Also more importantly it will help these women help give a better future to there children with good education and the safety and emotional security of a stable family.Good effort Sonali!

  21. Well there are some positive and negative points regarding legaliztion of prostitution:

    Positives:

    1
    People who are in this profession already suffer so much trauma for being in such profession. When there are raids by police such people are completely devastated perhaps by police torture.

    And everybody know about police torture.It can also be seen in the movie New york. So by legalizing such police atrocities will not be there.

    People are thinking it will make the society immoral.But that is wrong. If some one has to use such services he or she will use them in either cases. On the contrary A person who don't wish to use them will never even if it is legalized.

    Again it's wrong to think that it will come in limelight. But ask any teenager they also know the meaning of prostituion. At the same time - good and bad also.

    By legalizing the problem of AIDS can also be tackled in a better way. Since their would be rules and regulations

    The conditions of brothels will be improved very much. Their could be guidelines made and they can be rendered more hygeinic.

    The major factor would be - prevention of crime and assaults. Some drunk customers won't assault the service provider and The pimps won't be able to blackmail the clients.



    Negatives:

    Well some pimps or dalals may use it in a very negative ways. They may force underage minors into this profession. The age certificates can easily be forged.

    For now i can think of these much.

    Conclusion:

    This profession was always there. And whether legalize it or not will continue to be there.
    People will keep continue to come in this profession. Same for the users.
